End User License Agreement (EULA)

Welcome to Mimikai. This Terms and Conditions agreement constitutes a legally binding End User License Agreement ("Agreement" or "EULA") between you (the "End-User") and the developers of Mimikai ("we," "us," or "our"). This Agreement governs your acquisition, download, installation, and use of the Mimikai mobile application ("App") directly through Apple's App Store or Google's Play Store (collectively, "App Distributors").
By downloading, installing, or using Mimikai, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not download, install, or use Mimikai, and you must delete the App from all your devices immediately.
We grant you a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use Mimikai on any compatible mobile device that you own or control, strictly as permitted by the Usage Rules set forth in the Apple App Store Terms of Service and the Google Play Terms of Service.
This license does not allow you to use Mimikai on any device that you do not own or rightfully control. You may not distribute, rent, lease, lend, sell, transfer, redistribute, or sublicense the App. You are strictly prohibited from deconstructing, reverse-engineering, disassembling, attempting to derive the source code of, modifying, or creating derivative works of Mimikai, or any updates thereof.
In strict compliance with Apple App Store Review Guidelines and Google Play Developer Policies regarding minor safety, you must be at least 13 years of age (or the minimum legal age required in your jurisdiction) to use Mimikai.
Mimikai does not knowingly target, market to, or collect information from children under the age of 13. If you are under the legal age of majority in your jurisdiction, you represent that you have reviewed this Agreement with your parent or legal guardian and that they consent to your execution of these Terms on your behalf. We reserve the right to immediately terminate or restrict access to Mimikai if it is discovered that a minor under 13 is utilizing the platform without verified parental oversight. Mimikai offers a subscription service tier to unlock advanced capabilities, billed at a recurring rate of $4.99 USD per month and $29.99 USD per year.
Platform intermediation: You explicitly acknowledge and agree that Mimikai operates entirely within the native digital commerce frameworks provided by the App Distributors. All commercial billing, credit card tokenization, invoicing, tax calculations, and payment tracking are executed exclusively by Apple Inc. (via StoreKit) or Google LLC (via Google Play Billing).
No direct access: We do not possess, store, manage, or have access to your personal financial records, credit card credentials, or banking data.
Because all financial architecture is controlled directly by the platform operators, we are legally unable to issue, manage, or process direct financial credits or refunds.
You explicitly acknowledge and agree that Mimikai is not a cross-platform application.
Platform lock: Premium subscriptions, active recurring purchases, and local configurations are strictly bound to the specific native ecosystem architecture where the transaction originated (Apple App Store / iOS or Google Play Store / Android).
Loss of purchase on different devices: If you migrate, switch, or attempt to transfer your deployment of Mimikai from an iOS device to an Android device (or vice versa), your active premium purchase and configurations cannot be recognized or transferred, resulting in the loss of your subscription benefits on the new device framework.
To access premium features on an entirely different operating system or separate platform account, you must purchase a completely separate and independent subscription on that respective storefront. We bear no liability or responsibility for refunding or validating active purchases across conflicting mobile environments.
To maintain technical health and platform stability (in compliance with Apple App Store Guideline 2.5.1 regarding performance), the App may integrate Google Firebase infrastructure. By using Mimikai, you agree that the App may utilize Firebase Crashlytics and performance monitoring to collect anonymized, aggregated diagnostic records.
These diagnostic logs consist strictly of stack traces, hardware identifiers, and operating system versions intended solely to resolve software crashes. No personally identifiable information (PII) is intercepted or linked to these logs. For a full description of data practices, see our Privacy Policy.
We retain all rights, title, and interest in and to Mimikai, including but not limited to all source code, software frameworks, visual interfaces, graphic layouts, algorithms, databases, logos, and trademark properties. "Mimikai" and its corresponding intellectual assets are protected under international copyright, trademark, and intellectual property conventions. Your localized license grants you no ownership stake or proprietary claims over the App's underlying architecture.
Mimikai is provided to you on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranties of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express, implied, or statutory, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that your enjoyment of Mimikai will be free from temporary interruption, that the App will meet your exact requirements, or that defects will be corrected instantaneously. In no event shall we be liable for personal injury, data loss, device corruption, or any incidental, special, or consequential damages arising out of or related to your deployment or inability to use Mimikai.
In compliance with Apple's Standard EULA requirements, you acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your formal acceptance of these Terms and Conditions, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof. A similar status is extended to Google for Android-based distributions.
We reserve the exclusive right to alter, modify, or update this legal Agreement at any chosen interval. When amendments occur, we will adjust the "Last updated" date at the top of this document. Your continuous engagement, opening, or running of Mimikai following the publication of revised terms implies a structural and binding acceptance of the updated Terms and Conditions.
